What is the ADU Legislation?
Proposed legislation to take effect in June may affect Mt. Lookout and the City of Cincinnati. The legislation will allow Accessory Dwelling Units to be built in the back yards of Single Family homes. They can be built up to 25′ high and within 3′ of the property line. There are more finite details but other notable features is that in some cases the size of the ADU can be up to the size of the existing primary residence as long as it is the lesser of the two.
Here is the actual ordinance.
It seems that most support the general intention of the initiative however throughout the city there are some questions about implementation.
The general concerns are:
- There are no off street parking requirements for the increase in potential renters or other family members that may move into the new units.
- Height that is allowed being close to the property line. Effectively the current rear and side setback rules for the primary resident do not apply to the new Accessory Dwelling Units.
- Ability for short term rentals do not have much ability to be monitored or enforcement by the city
